End User License Agreement (EULA)
Welcome to the End User License Agreement (EULA) of Enterprise Stratagem (“Enterprise Stratagem,” “we,” “us,” or “our”). This agreement governs your use of any Software(s), applications, or other digital products (“Software(s)”) provided by Enterprise Stratagem.
By installing, accessing, or using the Software(s), you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, do not install, access, or use our Software(s)(s).
Subject to the terms and conditions of this EULA, Enterprise Stratagem grants you a limited, non-exclusive, non-transferable, revocable license to use the Software(s) for your personal or internal business purposes. This license is contingent upon your compliance with all applicable laws and regulations.
You may not:
Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software(s). Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Software(s). Use the Software(s) for any unlawful purpose or in violation of any applicable laws or regulations. Transfer, sublicense, or distribute the Software(s) to any third party without the prior written consent of Enterprise Stratagem.
The Software(s) and all intellectual property rights therein are and shall remain the exclusive property of Enterprise Stratagem and its licensors. Nothing in this EULA shall be construed to transfer any ownership rights in the Software(s) to you.
THE SOFTWARE(S) IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ENTERPRISE STRATAGEM DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ENTERPRISE STRATAGEM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE(S).
You agree to indemnify, defend, and hold harmless Enterprise Stratagem, its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with your use of the Software(s) or your breach of this EULA.
Enterprise Stratagem may terminate this EULA at any time if you fail to comply with any term or condition of this agreement. Upon termination, you must cease all use of the Software(s) and destroy all copies of the Software(s) in your possession or control.
This EULA shall be governed by and construed in accordance with the laws of Islamic Republic of Pakistan. Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of Islamic Republic of Pakistan.
This EULA constitutes the entire agreement between you and Enterprise Stratagem regarding your use of the Software(s) and supersedes all prior or contemporaneous agreements and understandings, whether oral or written.
